Are you fully covered as a senior placement agent?

We see a lot of independent contractors used in the senior placement/referral industry in particular. We understand; independent contractors fill many roles with less cost than hiring full-time workers. However, just because they are “independent” doesn’t mean you are risk-free should a job-related incident occur. If a 1099 worker injures somebody else, causes damage or makes a mistake while working on your behalf, there is a good chance that you are going to get dragged into an insurance claim or litigation.

Other companies claim to cover you. But, in reality, they classify you as a “consultant”, which often limits coverage to those of a business consultant, NOT a placement agent.

Secondly, you must verify that the facilities you are recommending have insurance. Odds are you didn’t realize it, but most states do not require insurance as part of a facility’s licensing process.  

If you place someone in an unlicensed facility and a wrongful death or injury occurs, the first person an attorney will go after is often the placement agent.
